Tree Preservation Order - Land at Parsons Lane, Addingham

City of Bradford Metropolitan District Council - Land at Parsons Lane, Addingham Tree Preservation Order 2024

This is a formal notice to let you know that on 4 April 2024 the Council made the above Tree Preservation Order.

A copy of the order is enclosed. In simple terms, no one is allowed to cut down, top or lop without the Council’s permission any of the trees described in the 1st Schedule of the Order and shown on the map.

The Council made the order because trees on the site are individually and collectively significant, contributing to the sylvan character and appearance of the area. The site is proposed for development (application reference number: 22/03295/MAO) and there have already been several trees removed from the site. A TPO is expedient to safeguard the remaining important trees and allowing for the appropriate control of any future felling or pruning works in the interests of amenity.

The Order is made to ensure the continuity of tree cover is controlled in accordance with good management and to protect those treescapes which are considered significant.

The Order came into force, on a temporary basis, on 4 April 2024 and will remain in force for six months. During this time the Council will decide whether the order should be given permanent status.

People affected by the order have a right to object or make comments on any of the trees or woodlands covered before a decision is made on whether the order should be made permanent.

If you would like to make any objections or comments, please make sure the Council receives them in writing by 2 May 2024. Your comments must meet regulation 6 of the Town and Country Planning (Tree Preservation)(England) Regulations 2012 (a copy is attached). Please send your comments to the Director or Legal and Governance at the address stated below or by email to legalobjections@bradford.gov.uk quoting reference CORP/PCD/JLF/415408. The Council will carefully consider all objections and comments before deciding whether to make the order permanent.

Copy of Regulation 6 of The Town and Country Planning (Tree Preservation) (England) Regulations 2012

Objections and representations

6(1)      Subject to paragraph (2), objections and representations:

  1. shall be made in writing and:
    1. delivered to the authority not later than the date specified by them under regulation 5(2)(c); or
    2. sent to the authority in a properly addressed and pre-paid letter posted at such time that, in the ordinary course of post, it would be delivered to them not later than that date;
  2. shall specify the particular trees, groups of trees or woodlands (as the case may be) in respect of which the objections or representations are made; and
  3. in the case of an objection, shall state the reasons for the objection.

6(2)      The authority may treat as duly made objections and representations which do not comply with the requirements of paragraph (1) if, in the particular case, they are satisfied that compliance with those requirements could not reasonably have been expected.
