Burley-in-Wharfedale Neighbourhood Plan Referendum

The Burley-in-Wharfedale Neighbourhood Plan Referendum took place on Thursday 3 May 2018 with an 82% vote in favour. Accordingly the Neighbourhood Plan now forms part of the CBMDC Local Plan and will be used to help determine planning applications within the Neighbourhood Area.

At present the Post Examination Version of the plan will be used until the title pages and headers are updated.

Burley in Wharfedale Neighbourhood Plan Information Statement

A Referendum relating to the Burley in Wharfedale Neighbourhood Plan will be held on Thursday 3 May 2018.

The question which will be asked in the Referendum is "Do you want City of Bradford Metropolitan District Council to use the neighbourhood plan for Burley in Wharfedale to help it decide planning applications in the neighbourhood area?"

The Referendum area is identified on the map which is included with this information statement. The Referendum area is identical to the area which has been designated as the Burley in Wharfedale Neighbourhood Plan Area.

A person is entitled to vote in the Referendum if:

  • He or she is entitled to vote in an election of any Councillor of City of Bradford Metropolitan District Council whose area is in the Referendum area
  • His or her qualifying address for the election is in the Referendum area. A person's qualifying address is, in relation to a person registered in the register of electors, the address in respect of which he or she is entitled to be so registered.

The Referendum expenses limit that will apply in relation to the Referendum is £2696.29.

The number of persons entitled to vote in the Referendum by reference to which that limit has been calculated is 5666.

The Referendum will be conducted in accordance with procedures which are similar to those used at local government elections.

    The Burley in Wharfedale Neighbourhood Plan, with modifications, will proceed to Referendum on the 3 May 2018.     Regulation 17 - Examination

    Andrew Freeman was appointed to carry out an Independent Examination of the Burley in Wharfedale Neighbourhood Plan and has recommended that, subject to modifications, the Plan should proceed to Referendum.

    Regulation 16 - Public Consultation

    Burley Parish Council submitted its proposed Neighbourhood Development Plan to the Council under Regulation 15 of the Neighbourhood Planning (General) Regulations 2012. In accordance with Regulation 16 (Publicising a plan proposal), the Council invited comments from organisations and individuals on the submitted Neighbourhood Plan and supporting documents.

    The consultation period lasted 6 weeks running from Monday 12 June until 5pm on Monday 24 July 2017.

    Regulation 14 - Draft Plan Consultation

    In accordance with Regulation 14, Burley Parish Council produced a draft version of their Neighbourhood Development Plan which was the subject of a formal consultation for 8 weeks from 5 September to 17 October 2016. Comments made to the Parish Council from this consultation helped inform changes to the document which has now been submitted to Bradford Council.     Neighbourhood Area Designation

    Burley in Wharfedale Parish Council applied to the City of Bradford Metropolitan District Council under Section 5 of the Neighbourhood Planning (General) Regulations 2012 to become a designated Neighbourhood Area on 29 November 2012. The Neighbourhood Area was approved by Bradford Council on 5 November 2013.

    Bradford Council officially publicised the designation application as required by Section 6 of the Regulations. The publicity period lasted 8 weeks from Monday 22 July until Monday 16 September 2013. Shipley Area Committee were invited to consider the Neighbourhood Area Application at its meeting on 30 October 2013.
