Tree Preservation Orders

What is a Tree Preservation Order?
A Tree Preservation Order is made by the Local Planning Authority and makes it an offence for any works/damage to be carried out to a tree without the permission of the Local Planning Authority. An Order is made to protect trees which are of significant value to the local surroundings.

How can I find out if a tree is covered by an Order?
Details of orders can be found at your Local Planning Authority's Offices or by contacting the Trees Team. A Land Search would also reveal the existence of an Order. All types of trees can be covered by an Order with the exemption of hedges, bushes and shrubs, and can cover a single tree through to an entire woodland.

Is the Local Authority responsible for looking after a tree if it is covered by an Order?
No, the owner remains responsible for the trees and any damage they may cause, but the Local Planning Authority's permission is required prior to any works being carried out.

What should I do if I think my tree is covered by an Order?
If you think that your tree is covered by a Tree Preservation Order and you want to carry out works to it, then an application needs to be made to the Local Planning Authority. Your application should specify the trees to which the application applies, what you want to do and why.

If you would like to check if your tree is covered by an Order please contact the Trees Team. Unauthorised works to a tree covered by an Order carry a maximum fine of £20,000.
