This new procedure should be applied in every situation where the Local Authority has concerns to the extent that it considers Section 31 threshold appears to be met (i.e. situations in which it would be considering the institution of Care Proceedings). It is important to recognise that this applies to pre-birth situations as well as situations involving children already known to the department. The expectation would be that pre-birth assessments have been carried out and the actions outlined in the Public Law Outline have been followed prior to Care Proceedings taken on a new born baby.
