Pavement cafe licence standard conditions
Highways Act 1980, Section 115 Part VIIA
Provision of facilities for recreation or refreshment.
The following conditions will apply to your use of the highway for pavement café purposes:
- A minimum clear width of 1.8 metres must be maintained between the boundaries of the pavement café and the kerb at all times. In a pedestrianised area there must be at least 3.5 metres of unobstructed space in front of the café.
- There must be an unobstructed corridor to the entrance to the premises of 2 metres at all times.
- A physical barrier one metre in height must be provided to guide persons with disabilities safely around the use. Such barriers must not be permanently fixed to the ground where this is a public highway.
- No storage of furniture, signboards etc or anything else associated with the business shall occur outside the barriers at anytime without the prior written consent of the City of Bradford Metropolitan District Council.
- All tables, chairs and any associated structures must be removed from the public highway after trading hours.
- Chairs, tables and boundary treatment must be of a design and materials agreed in writing by the City of Bradford Metropolitan District Council before the use commences.
- The area of the pavement café shall be kept free of litter and cleansed regularly, with food debris and other waste removed immediately.
- Consent to use the highway for this purpose is valid for 12 months from the date of the Licence.
- Indemnification for the City of Bradford Metropolitan District Council of up to £2 million against all claims, injuries or accidents must be provided and maintained for the duration of the agreement.
- Noise, disturbance, smells or litter which cause a nuisance to other premises are not acceptable and amplified music will not be permitted.
- No alcohol shall be consumed on the highway unless a licence has been issued by the City of Bradford Metropolitan District Council. The Police advise that businesses who have a licence to serve alcohol outdoors must not trade from the pavement café after 6.00 pm.
- Food and drink must be transferred from indoor premises to the outdoor area by waitress or waiter service.
- Toilet and hand washing facilities must be provided.
- The City of Bradford Metropolitan District Council will not be liable for any loss of business or other disruption caused by third parties, including private contractors or works by statutory undertakings.
- The City of Bradford Metropolitan District Council reserves the right to revoke the Licence if breaches of the terms and conditions occur.
