  • It is best practice to do this in consultation with all relevant partner agencies and the APRAC MUST consult with any organisation that may have a duty to investigate. They MUST be sent a copy of the AP1 form
  • The decision MUST be made within two working days of the referral being received
  • Except if it would override another person’s right to safety the views of the person at risk of abuse or neglect (or those of the person acting in their best interests mental capacity) will form an important consideration in any decision made
  • The safety of those at risk who do not have mental capacity to protect themselves is paramount
  • The adult protection procedures MUST be used when

– there is no clear evidence that this situation is NOT about abuse or neglect

AND

– The person who may be experiencing abuse or neglect does not have mental capacity to make decisions about their own safety

OR

  • The abuse or neglect has occurred on property owned or managed by an organisation with a responsibility to provide care

OR

  • The person alleged to be causing the abuse or neglect is/are:

    – staff
    – volunteer/s
    – a person (such as another service user) who only comes into contact with the person experiencing abuse because they both use the service

OR

  • Other people covered by this policy are also at risk from the same person/people
  • If the decision is made NOT to follow the adult protection procedures the AP1 form MUST still be completed
  • The APRAC will designate the person most appropriate to feedback to the person about whom the concern of a risk of abuse has been raised. This will often be the alerting manager or the alerter. Where the person does not have the mental capacity to understand the concerns or that a referral has been made, feedback will be given to the person acting in that person’s best interests e.g. their carer, deputy
  • The APRAC will decide who will feedback to the person thought to be causing a risk of abuse. Where that person does not have the mental capacity to understand the concerns or that a referral has been made, feedback will be given to the person acting in that person’s best interests e.g. their carer, deputy
  • The APRAC will decide, in consultation with the alerting manager, whether there are reasonable grounds for believing that the person causing the risk of abuse may cause significant harm or danger to life or limb or may be a risk to others. If that is the case then a hazard warning will be placed on their name within the adult service data base.
